The New Mexico Medical Review Commission

Updated October 24, 2026 · Checked against the New Mexico Medical Malpractice Act as amended through HB 99 (2026)

When the panel is required

Before filing suit against a qualified independent provider who is an individual (for example, a doctor in private practice), the claim generally must be submitted to the Medical Review Commission and a decision issued, unless both sides agree to waive it (NMSA 41-5-14 and 41-5-15). Claims against hospitals and hospital-controlled facilities have been excluded since July 1, 2021.

How it works

A panel of health care providers and lawyers reviews the claim. Its decision is advisory: it does not bind either side or stop a lawsuit.

Effect on the deadline

Filing an application pauses the limitations period for the providers named in it (NMSA 41-5-22). It does not protect a provider who was left off the application.
